What did we agree with Al Wakrah about delay damages?
إ

Capped at 10% of the contract value, charged weekly, and the clock only starts once they have signed off the revised programme.

"Liquidated damages shall accrue at 0.5% of the Contract Price per completed week of delay, subject to an aggregate cap of 10%, calculated from the date of the Employer's approval of the revised programme."

Two things worth knowing. Ahmed flagged in July that the same clause was negotiated down from 15% on the Lusail job, so 10% is your precedent now. And the programme approval condition is the part that usually gets missed, because it moves the start date.

Subcontract, Al Wakrah cl. 14.3 Commercial review 14 Jul Ahmed Al-Mansouri note
Can we use the same cap on the Msheireb tender?
إ

Your last four subcontracts all landed between 10% and 12%, so 10% is defensible. I cannot tell you whether it is the right commercial call on this one, because that depends on the programme risk and I have no cost data for Msheireb yet.

This is the kind of question Ahmed should answer with you rather than one I should answer alone.
